This is something that a lot of people get confused. Separate property is property that you (or your spouse) acquired before you were married. It includes the following types of property:

  • Anything that one of you acquired as a personal injury award,
  • Anything that one of you received as a gift,
  • Anything that one of you acquired as an inheritance.

On the other hand, community property is any property that (or your spouse) acquired during the marriage. Community property does not include following types of property:

  • Anything that one of you acquired as a personal injury award,
  • Anything that one of you received as a gift,
  • Anything that one of you acquired as an inheritance.
